Meta threatens to quit Facebook and Instagram if EU does not adjust privacy rules
Facebook parent company Meta Platforms is considering leaving Europe if the group is no longer allowed to exchange data of European users with the United States. The social media company repeats this message in a document that the group has submitted to the American securities regulator SEC.
It is not the first time that the company behind Facebook, WhatsApp and Instagram, among others, has made such a noise. Indeed, in 2020, Facebook was told by privacy regulators in Ireland that it can no longer use standard contractual clauses to comply with privacy rules when sending data to the US.
Personal data
The Irish authorities had imposed the ban on Facebook because of the European Court of Justice's annulment of the data-sharing arrangement known as the Privacy Shield. According to the court, personal data is less protected in the US than in Europe. Facebook immediately warned that halting transatlantic data transfers could have a devastating impact on the company. The company depends on processing user data to offer targeted online ads.
The Irish data regulator is currently still conducting an investigation. Meta is therefore still waiting for a final decision in the case. That may come in the first half of this year. In that context, the U.S. company is now warning that if there is no proper resolution, "we will likely not be able to offer some of our most important products and services, including Facebook and Instagram, in Europe."
The case began several years ago with a complaint by Austrian privacy activist Maximilian Schrems about Facebook Ireland, the company's European headquarters. Schrems had complained to the Irish Data Protection Authority about Facebook Ireland's transfer of personal data to its parent company in the US. He questioned whether they were adequately protected in the US.
